Kid bought my rx-7. Gave me 250 up front, and drove the car away. I still have the title. I've been bugging him for the last 750 for a couple weeks now, and he's said that he's "sent it in the mail" twice now. YEah, right. In the whirwind which was the breakup of me and the ex, i lost the bill of sale, and consequently, the guys name and address. All i have to go on right now is his phone number, which i traced to (waht i assume) is his dad, in providence. Unfortunatley, all the trace gave me was the city, not the address.

what the hell do i do.... legally that is.

If you want the full address from the phone number go to www.smartpages.com and do a reverse-lookup. This will work unless it is a cell-phone. But since you lost the bill of sale you are pretty much screwed. You could take him to small claims court but, you don't even have his name or address so it'll be pretty hard to do that. Even if he did show for court you have no documentation of how much the car was "actually" sold for. Next time either get all the money up-front or, hold on to your paperwork. Peace-

Oz is onto it. He has your car, which is titled in your name. That's the bottom line. There is NO bill of sale.

I'd call him, tell him to bring the $750, cash, in person, or the car back by a certain date or time. Then at that date and time, report the car stolen if he hasn't come by. Done deal.

would they let you keep the $250 ? i can only assume they would if you argued that he "gave" it to you, since he gave you money, took the car (you consented to that, he didnt grab the keys and run) and you still got the title.

Report it stolen, its still in your name. What bill of sale? Is there any proof he gave you the money? The way I see it, he tried to screw you and you will come out on top...

Yeah, i've actaully had a ton of people suggest that i report it as stolen, and i've been thinking about it.

The only problem I forsee is if he still has HIS bill of sale.. you know the standard I so and so sell this car balh balh to so and so for such and such an amount.

But the true point is that until i get that last bit of money, its MY car, just like if you take a loan from a bank to buy a car, its the BANKS car, not yours... and they repossess stuff all the time.

Jesus this is such a PITA. Never again.

The kid has my car. I let him have the keys a few weeks ago, he was supposed to come back, we agreed on that. He never came back. I have the title. I want my car back.


they'll probably have some tough questions like "Why did you give him the keys." Tough question but again, tell them only what you want them to hear...

Do what a friend and I did: take it in the middle of the night. One of my friends cosigned for a girlfriend, they split up, he ended up making the payments. 2 months later we found the truck, he still had keys, he got in it, started it, I called the house talked to her told her to look out the window, now you see it now you don't, if you want the truck back get it financed on your own, otherwise its gone. Worked pretty good, she called to report it stolen, we had already called the local pd told them we were taking it and why.

yea, he said he only has a phone number, he lost the thing with the address on it. so it would take ages to search for the car, if you even find it.

er, no i dont think so.

But the #1 fact here is that *I* still have the title, and I still own the car, and i can repossess it if i so desire.

If you were to go to court after buying a car, but you didnt get the title, the judge would say you're SOL for not getting the title.

Exactly... do you know anybody that knows a lot about the law? Talk to somebody for advice if you can, and then phone the kid and explain to him that you will be taking the car back...

Any luck finding his address using his phone number?

report it as stolen. once you see him driving call cops on vehicle for "erratic driving" that will get the cops to him faster. just a thought
