I was driving through the Office Depot parking lot today, just minding my own, and I see this Xterra start backing up. Well, she stopped, so I assumed that she saw me and was going to let me go, seeing as how I had the right of way.
Whoa was I wrong. She kept backing out! As I was going. Well, I sped up to avoid getting my truck rammed, but to no avail. She totally fucked up the back left side of my truck.
As I get out of my truck to talk to her, she looks at me (oh yeah, she was like, a 20-year-old Abercrombie snotty rich stupid snob...) and says, "I was backing out!" with the hugest attitude in the world. :eek7:
I looked at her and said, "Yeah, and I was driving. And if I'm not mistaken, I had the right of way and you should have looked before you backed out."
She goes, "Yeah, but I WAS BACKING OUT!" And I said, "Is everyone supposed to stop when you feel like backing out?"
Well, feeling totally confident that it wasn't my fault, the cop gets there and tells me that it's no fault because he's a "crash reconstructionist" and he knows for a fact that I was going about 20 mph when it happened. I told him I was going that fast because I saw that she wasn't going to stop and I was trying to avoid getting hit.
Anyway, another cop came and told her that there's a 5% chance she can take this to court and find me totally at fault because I was speeding. And that's more than likely what she's gonna do, because she's a retarded bitch!
We both got tickets, mine for speeding. My mom works for a lawyer, and I'm gonna go talk to her, because this is absolute bullshit that me being a defensive driver turned into this whole thing being my fault because she couldn't turn around to look where she was going. I don't know what I'm gonna do.
*edit* Oh yeah, and for future reference, don't ever speed up to avoid something. I should've just sat there when I saw she wasn't going to stop. Then I wouldn't be at fault at all.
And since when is 20 mph speeding on private property when there's no speed limit posted?

Agh. That's the fiberglass sticking out. Damn her. I cannot stress enough the fact that she backed into me! It is 100% her fault.

I think in parking lots there's a speed limit of 10 mph but don't hold me to that.
Anyway, I hope nothing happens because she backed into you. You didn't run into her as I see it and she's at fault, case closed. I hope things turn out ok though.

I know I could've. I was being quiet and nice and polite, and she was going off on the cop. She had a really shitty attitude. i had something somewhat similar happen to me recently. I was backing out of the parking lot at the grocery store and I drive a s10 blazer so there is a wicked blind spot in the rear sides. This jackass in an integra comes flying around the corner and just barly hits me before I slam on my breaks. He starts honking and screaming and telling me that I hit his car. I'm like get the fuck out my way believe me I would've known if I hit your car. So I get out and the guy starts to shut up because I'm 6'7'' at like 250lbs. (people don't generally start shit with me) but then he points to a broken headlight and scratches and scuffs and I'm like so wheres the damage to my car? He's like well you're driving an SUV its tough(ok my blazer is lowered with a urathane body kit so if if anything even bumps my car you can tell). So he is insistant on calling the cops, and I'm like call the fucking cops all they're gonna do is ticket you for having a broken headlight and falsely reporting an accident. At this point he realized that I was failing for his stupid stunt and told me that because no one saw and there was no damage to my car that cops wouldn't believe him. But then he tells me that he's gonna write down my plate number and call the cops and tell them I did a hit and run. This is when after being mad cool about the whole thing I get in his face and tell him to try it, after I'm done you won't be able to drive. Now he looks as though he's about to piss himself and runs back to his car and drives off. Some people are such scumbags. Peace-

Nicole - DON'T EVER ADMIT YOU WERE SPEEDING. At best, state: I was driving at a speed appropriate to the situation, and wasn't looking at my speedo - I was looking at the car about to f*cking hit me!!

He neglected to mention how fast she was going as she was backing out of her parking place. Pretty damn fast.
And then he tried to tell me that he could tell exactly where the point of impact was because there was a pile of glass in the middle of the road. But, instead of the point being where all the glass was laying, it was 2 feet over where 1 lone piece of glass lay. There is the problem that when a person is backing up the people that are driving are supposed to let that person out because they can see much better. BUT she also as you said hauled out of that spot, soooo who knows.

The thing is she hit the BACK END of my truck, not the front. Even if I would've stopped when I saw her backing up, she would've hit me. It just would've been in the middle of my truck.

This happened to me once. Luckily I nailed the gas and swerved out of the way in time to avoid being hit, and them my friend who saw it all from the sidewalk went and yelled at the lady for me. :lol2:

I didn't want to make a thread of this and not trying to hijack, but the other day at McDonalds drive through. I was waiting in my truck, and i was rolling forward very very slowly, and I bumped the lady in a van, just being a smart ass that I am I say" What did you do" she just gets all pissed off and drives away. HAHA It was GREAT...My friend that was with me laughed his ass off. BTW her plastic bumper cover was just dented in one spot...haha.

The law in most states is that when you are backing, you have a duty to insure that it is safe to do so.
Speed of Nicole's vehicle canNOT be proven without radar or a policeman at the scene. Since the cop wasn't there when the accident occurred, AND it occurred on private property, there should have been no tickets issued.
The courts should throw out Nicole's ticket, the cop didn't witness the accident, nor how fast she was driving.
This should have been handled by the insurance companies. The bitch that was backing owes for Nicole's vehicle repairs, pure and simple.

Her insurance doesn't have to pay for my damage right now. Florida is a no-fault state, and since the accident was in a parking lot and we both got tickets, we're both at fault. My court date is September 29th, and I'm going Monday to get the crash report from OCPD.

Cops do wierd stuff. A lady in a minivan made a friend of mine pullover (he was in a 96 eclipse). She said that he hit her rear bumper at the previous traffic light. He didnt know what the hell she was talking about; there wasnt even a scratch on her car, let alone him ever having hit her in the first place. So a cop comes along much later, listens to the whole deal, and gives my friend a "speeding ticket" for doing 45 in a 40 zone to make him "pay" for "hitting" the lady's van. Can you beleive that? Out of the blue, a baseless speeding ticket... complete BS. so yeah, youre not alone!! We should form some kind of "People-Against-Bullshit-Ticket" club.

Her insurance doesn't have to pay for my damage right now. Florida is a no-fault state, and since the accident was in a parking lot and we both got tickets, we're both at fault. My court date is September 29th, and I'm going Monday to get the crash report from OCPD.

i hate that no-fault BS. Colorado revoked about a year or two ago. It lowered my premiums over $400/6mos because i didn't have to carry extra medical coverage. i hate that your insurance will go up because your ins. will pay for hers and hers will go to to pay for yours. Capitalism at it's best!

I hate to start a new thread on this, so I'm bringing this one back. I went to court earlier today, and neither the cop nor the girl that hit me showed up, so my ticket got dismissed. YAY!!!
Now she has to pay to fix my truck. I'm ecstatic. My month has been made. Shit, maybe my whole year.

I have her insurance info, I'm going to get some estimates tomorrow and send them to her insurance company. I don't really care whether her insurance pays for it or she does, as long as it isn't me.

She's the one that wanted to get tickets at the scene. The cop told her that he didn't have to cite anyone if we both agreed to work it out. But she cried and said she wanted insurance info and tickets. I offered to let her pay for my truck...haha. Had I not gone to court I would've had to pay for my ticket and my truck to get fixed because Florida is a no-fault state if neither party is ticketed.
Anyway, it is a big deal seeing as how it cracked the fiberglass and they estimated it at about $800-$1000. That's money that I don't exactly have. Has anything ever happened to your vehicle? Anything is worth getting upset over when you're making payments and someone doesn't want to take the blame for something that was their fault.

Nicole, be careful, up here if your claim is more than 30 days its a big pain in the ass to get the insurance company to pay. You will probably have to send them copies of the court paperwork showing she was ticketed and didn't show up. Be prepared for it, and don't back down. When the adjuster shows up to look at the damage and tries to get out of paying it, show them the highest estimate you have, tell them you want the work done there. I've done it, even when they say its lower I usually get the higher amount. Plus, they will have to pay for a rental, and if you are under 25 its really expensive if you can find anyone who will rent you a car. Good luck.
