Hey guys and gals..
I'm in California, Los Angeles got tagged for LAMC 80.73.1
The car is a Toyota Camry, fully registered and insured, moves several times weekly to store, post office, etc (approx 5~6 miles weekly). Always park back in the same spot, record time, date, mileage on a log-sheet placed on the drivers seat, visable to any on-looker.
The ticket was for 80.73.1 specifically written in a blank spot, with a comment "observed vehicle in same place previously".
I went the first mile and requested a written administrative review with the parking enforcement folks, which was responded "Citation Valid". Next step is another review, this time in person... Then the final step is an actual Los Angeles court, with an actual judge.
Has anyone had this 80.73.1 ever cited against you here in L.A. city that can shed some light on what these guys think they hold over me ??
Maybe one of you legal interpreters can read the text of this law and point out where these guys have me by the nuts ?? I can't see any part of this law applying to parking this Camry on the street.

(a) No person who deals in or whose business involves the sale, rental, leasing, repair, repossession or transportation of new or used vehicles shall park or leave standing on any one or more streets or alleys during the conduct of such business any vehicle held for sale, trade, rental, leasing, repair, repossession, shipment, transportation or other disposition.

(b) It shall be unlawful for any person who deals in or whose business
involves the wrecking, junking or dismantling of used vehicles to park, store, or leave standing on any public street, alley, way or place any vehicle or part or parts thereof which has been delivered to him or which is in his possession or custody for wrecking, junking or dismantling.
(c) It shall be unlawful for any person to park or leave standing on any public street, alley way or place, any vehicle pending delivery or during delivery to a person who deals in or whose business involves wrecking, junking or dismantling of used vehicles, unless the vehicle so parked or left standing is currently licensed by the Department of Motor Vehicles and is fully operable.

Steven, It just soudns like LAPD wants some cash out of you. I would go and contest it. Bring your milage log and show the judge what is up.

Somebody(s) reported your car to the police as a possible abandoned vehicle. If it's parked in front of your house, there should be no problem, especially since the registration would/should match the house address. Plus in most of L.A. city/county, there's usually a street cleaning day every week, so you would have to move your car on that day or get a ticket. The first ticket usually is written as a beginning point/marker and if 3 tickets are issued (3 weeks worth), the police will call out the tow truck and haul it away. Also, look to see if there are any new signs put up for street cleaning. The city usually doesn't send out any notices and they also change the street cleaning times without notice too, so you have to check the signs just to be sure.
If you are parking in front of somebody elses house, then that person may be pissed that you are taking their parking spot. I know of elderly people that have had the city paint a handicap only parking (with sign) in front of their home, so they have a convenient, easy accessible parking spot. There also may be a neighbor that is selling cars in your area and is causing parking problems and your car may have been called in by mistake.
Bring to court your logs, registration, and photographs of the condition of your car and where you are parking. The logs should show you are using the vehicle, registration would validate you are parking close to your primary residence, and if pictures of your car show that it is relatively well kept and clean, you should be able to avoid paying the ticket. But that all depends on the judge.

These are great pointers and advice as well. I'm still wondering how they can read 80.73.1 as the Camry, complaining neighbor or otherwise.
Am I reading this wrong ? Isn't everything in that law regarding catering trucks, and/or wrecking yard deliveries ?
Or.. is it possible that simply the Title of 80.73.1 is the law without regard to sub-sections a) b) c) or d) ?? I'm not reading it like that though, looks to me like just the Title.

Well, that's the Title, no doubt about that. But then there's no text describing what that Title means, other than sub-sections a), b), c), and d) which reference, like I said, Wrecking Yard Deliveries, Catering Trucks, etc.
As far as "pertains to...", wouldn't "pertains" require a description of the law?
My point is, no-where in this law is specifically written that I can't park, store, whatever term we're using my Car on the streets. Just the Title implies that without further example.

Some local cop (#30068 Piceno) has a bug up his ass for this car, the whole thing gives me a good chuckle at this point 'cause I get paid 100% plus lunch bonus' for going to court :iceslolan :iceslolan
Anyway, I've been down there three seperate times now contesting these rediculous citations, and all three were dismissed.
Each time it gets funnier 'cause I can name the previous dismissals as precedence, and I'm 'outa there in 10 minutes, then take a two hour lunch. :smokin:
I have a fourth one I'm contesting before July, it'll be dismissed as well :lol2: :lol2:
Free lunch on the company, time off from the stress of work...
Hats off to the dumb-ass officer that keeps this rolling !!
